Renting with an ESA in Tallahassee and Leon County

Tallahassee is the state capital and a college town. Much of the rental market is off-campus student housing, with longer-term apartments and houses for people who work in state government, the universities, and the hospitals. The Florida law is the same as in every other county.

Off-campus student housing
Student leases near FSU, FAMU, and TCC are often marked no pets and may be signed by a parent as guarantor. An off-campus landlord still has to consider a written housing request. If you live in campus housing, ask the school's housing office how it takes accommodation requests.
Leases that follow the academic year
Many student leases follow the academic year, so a lot of people sign at the same time. If you plan to move in with your animal, send the written request with your application or before you sign, so the manager has the letter in the file when the lease starts.
Longer-term renters across Leon County
Apartment communities and single-family rentals across Leon County use the same written packet: a request, a clinician letter, and ordinary lease paper such as vaccination records. A registration card or vest is not part of that packet.

The Florida Commission on Human Relations, which takes housing discrimination complaints under Florida law, is based in Tallahassee and takes complaints from every Florida county. Official ESA Letter does not file complaints and does not give legal advice.

Florida Fair Housing basics for ESA requests

The federal Fair Housing Act treats a refusal to make reasonable accommodations, when they may be necessary, as discrimination (42 U.S.C. 3604(f)(3)(B)). Florida's ESA housing law is Fla. Stat. 760.27, and it applies statewide, in Tallahassee the same as in every other Florida county.
When a disability or the need for the animal is not readily apparent, a landlord, HOA, or condo board can ask for reliable supporting information. Florida law lists information from a telehealth provider, as defined in s. 456.47, among that information (Fla. Stat. 760.27(2)(b)4).
A housing provider may not request information that discloses the diagnosis or severity of a disability or any medical records (760.27(3)(a)), and may not require a specific form or a notarized statement (760.27(3)(b)).
An internet registration, ID card, patch, or certificate is not, by itself, sufficient information (760.27(3)(c)). See ESA letter vs registry.
A request can be denied if the animal poses a direct threat that another reasonable accommodation cannot reduce or eliminate (760.27(2)(a)). You stay liable for damage the animal causes (760.27(4)). More in what Florida landlords can ask.
