What Florida HOAs and condo associations can and cannot do with a clinical ESA letter under Fair Housing and Fla. Stat. § 760.27.

Florida HOAs and condo associations are often covered by the Fair Housing Act when they control housing rules. A clinical ESA letter is documentation for a reasonable accommodation request — not a free pass to ignore legitimate safety or health rules.
What HOAs generally may not do
- Charge pet deposits, pet rent, or pet fees solely because of a documented ESA
- Enforce arbitrary breed or weight bans against a documented assistance animal in the same way as pets
- Demand detailed medical records or a specific diagnosis
What HOAs may still do
- Request reliable documentation from a licensed professional
- Verify the clinician’s license
- Address direct threats or substantial property damage on a case-by-case basis

Florida law reinforces that internet registration alone is not enough. Associations that have seen fake paperwork increasingly expect a clinical letter with credentials they can check.
