Is there a 30-day waiting period in Florida's ESA law?
No. The 2026 text of Fla. Stat. 760.27 has no waiting period, no minimum treatment length, and no required number of days.
A search of the section for "day", "week", "month", "period" and "wait" finds nothing. Read the full section on the Florida Senate site: Fla. Stat. 760.27 (2026).
The only count in the section is in subsection (2)(b)4 and applies to a practitioner licensed in another state:
but only if such out-of-state practitioner has provided in-person care or services to the tenant on at least one occasion.
That counts occasions, not days, and it covers a practitioner licensed in another state only if that condition is met. The statute contains no 30-day requirement.
What does Fla. Stat. 760.27 ask of the clinician?
The statute asks for a clinician with personal knowledge of the disability who is acting in scope of practice. It sets no number of days.
Subsection (2)(b)4 lists information from "a health care practitioner, as defined in s. 456.001; a telehealth provider, as defined in s. 456.47". It then says that such information is reliable if the practitioner or provider has personal knowledge of the person’s disability and is acting within the scope of practice to provide the supporting information.
Does an internet registration or certificate count?
No. Under subsection (3)(c), an internet registration, ID card, patch, or certificate is not, by itself, enough to establish a disability or a disability-related need.

An emotional support animal registration of any kind, including, but not limited to, an identification card, patch, certificate, or similar registration obtained from the Internet is not, by itself, sufficient information to reliably establish that a person has a disability or a disability-related need for an emotional support animal.
How does an evaluation work at Official ESA Letter?

- The clinician calls after payment. The clinical conversation can be in English or Spanish.
- The clinician approves or does not approve a letter.
- If approved, the customer gets a signed English PDF for the landlord.
- Full refund only if the clinician does not approve a letter.

What if a landlord has a separate waiting rule?
A landlord's own written policy is a separate matter from the statute. Ask for the policy in writing and read what it says.
Subsection (3)(b) speaks to routine methods. It says a housing provider "may develop and make available to persons a routine method for receiving and processing reasonable accommodation requests for emotional support animals; however, a housing provider may not require the use of a specific form or notarized statement, or deny a request solely because a person did not follow the housing provider’s routine method."
